In this dissertation, I have analyzed some of the problems associated with male reproduction. I discuss basic notions regarding the origin of parental rights concluding that whatever rights parents have regarding their children arise because of the biological connection between the parents and child. A biological parent has prima facie rights to his child because that parent has property-type rights to his own body. ;I suggest that parental responsibilities automatically incur whenever the conception of a child is intentional or voluntary, (...) or when conception is the result of negligent or reckless sexual activity. Only when procreation is involuntary does automatically delegating parental responsibilities to a male seem morally problematic. The category of acts which would constitute involuntary procreation, however, is very narrow. ;I discuss morally problematic issues that arise when a child is born against the wishes of the male progenitor. Focusing specifically on the issue of child support, I conclude that the father should have some responsibility for the support of the child. The only time for which the imposition of parental responsibilities upon a reluctant father is morally questionable would involve the fraudulent misrepresentation of the female regarding her use of contraceptives, combined with some affirmative action by her to undermine the male's attempted effort at contraception. ;Finally, I discuss the moral and legal implications of a woman's decision to obtain an abortion against the wishes of the potential father. I conclude that her abortion could seriously harm the male's procreation interests. But, given the vital role women have in the reproductive process, women should possess rights superior to those males might possess. The evolution of reproductive technology, however, has made these greater rights a contingent fact. (shrink)

In this paper, my aim is to understand the origin of experimental and scientific models of pathogeny of the diseases of the nervous system in the Salpêtrière (Paris). I will analyse the role of the contexts of cell theory, microscopy and the advances in histological techniques in the creation of various pathogenic models, based on the concept of the cell, the Wallerian degeneration and the neurone concept. I argue that, as medicine and pathology remain autonomous in their methods and goals, (...) because of the evident degree of complexity of diseases, close and reciprocal interactions with sciences, their practices and theories, make it possible to establish convergences between clinical observations, pathological data and those from the experimental models of pathologies. The search for pathogenic models behaves like an engine, which is efficient in assembling facts, in testing pathogeneses and reforming nosologies, combined with the breakthroughs in biology. This paper is a case study showing the emergence of such interactions in the last decades of the nineteenth-century in Paris. (shrink)

The problem discussed here is to find a basis for a uniform treatment of the relation between pronouns and their antecedents, taking into account both linguists' and philosophers' approaches. The two main candidates would appear to be the linguists' notion of coreference and the philosophers' notion of pronouns as variables. The notion of coreference can be extended to many but not all cases where the antecedent is non-referential. The pronouns-as-variables approach appears to come closer to full generality, but there are (...) some examples of pronouns of laziness which appear to resist either of the two approaches. (shrink)

Delivering high quality genomics-informed care to patients requires accurate test results whose clinical implications are understood. While other actors, including state agencies, professional organizations, and clinicians, are involved, this article focuses on the extent to which the federal agencies that play the most prominent roles — the Centers for Medicare and Medicaid Services enforcing CLIA and the FDA — effectively ensure that these elements are met and concludes by suggesting possible ways to improve their oversight of genomic testing.

Within psychology, at least two research communities study spatial cognition. One community studies systematic errors in spatial memory and judgement, accounting for them as a consequence of and clue to normal perceptual and cognitive processing. The other community studies navigation in real space, isolating the contributions of various sensory cues and sensori- motor systems to successful navigation. The former group emphasizes error, the latter, selective mechanisms, environmental or evolutionary, that produce fine-tuned correct responses. How can these approaches be reconciled and (...) integrated? First, by showing why errors are impervious to selective pressures. The schematization that leads to errors is a natural consequence of normal perceptual and cognitive processes; it is inherent to the construction of mental spaces and to using them to make judgments in limited capacity working memory. Selection can act on particular instances of errors, yet it is not clear that selection can act on the general mechanisms that produce them. Next, in the wild, there are a variety of correctives. Finally, closer examination of navigation in the wild shows systematic errors, for example, over-shooting in dead reckoning across species. Here, too, environments may provide correctives, specifically, landmarks. General cognitive mechanisms generate general solutions. The errors inevitably produced may be reduced by local specific sensori-motor couplings as well as local environmental cues. Navigation, and other behaviors as well, are a consequence of both. The United Nations (UN) Universal Declaration of Human Rights engenders important state commitments to respect, fulfill, and protect a broad range of socio-economic rights. In 2010, a milestone was reached when the UN General Assembly recognized the human right to safe and clean drinking water and sanitation. However, water plays an important role in realizing other human rights such as the right to food and livelihoods, and in realizing the Convention on the Elimination of All Forms of Discrimination against Women. (...) These broader water-related rights have been recognized but have not yet been operationalized. This paper unravels these broader water-related rights in a more holistic interpretation of existing international human rights law. By focusing on an emerging approach to water services provision—known as ‘domestic-plus’ services—the paper argues how this approach operationalizes a comprehensive range of socio-economic rights in rural and peri-urban areas. Domestic-plus services provide water for domestic and productive uses around homesteads, which challenges the widespread practice in the public sector of planning and designing water infrastructure for a single-use. Evidence is presented to show that people in rural communities are already using their water supplies planned for domestic uses to support a wide range of productive activities. Domestic-plus services recognize and plan for these multiple-uses, while respecting the priority for clean and safe drinking water. The paper concludes that domestic-plus services operationalize the obligation to progressively fulfill a comprehensive range of indivisible socio-economic rights in rural and peri-urban areas. Cultural difference has been largely ignored within bioethics, particularly within the end-of-life discourses and practices that have developed over the past two decades in the U.S. healthcare system. Yet how should culturebe taken into account?

Certified nursing assistants (CNAs) provide up to 80% of the direct care to older adults in long‐term care facilities.CNAs are perceived as being at the bottom of the hierarchy among healthcare professionals often negatively affecting their job satisfaction. However, manyCNAs persevere in providing quality care and even reporting high levels of job satisfaction. The aim of the present investigation was to identify primary themes that may helpCNAs make meaning of their chosen career; thus potentially partially explaining increases in job satisfaction (...) among this group. Focus groups were conducted withCNAs at three long‐term care facilities. Four themes emerged from the data:CNAwork is good or special;CNAas relationship builder;CNAas expert;CNAas team member. These themes reflect the perceptions that theseCNAs held in regard to themselves and their relationships to others in the work environment and, when present, can contribute to intrinsic job satisfaction. Our meaning‐making themes support the premise thatCNAs do not passively accept the evaluations of others but instead actively frame identities that validate their importance to residents and the institution. Does context and context-dependence belong to the research agenda of semantics - and, specifically, of formal semantics? Not so long ago many linguists and philosophers would probably have given a negative answer to the question. However, recent developments in formal semantics have indicated that analyzing natural language semantics without a thorough accommodation of context-dependence is next to impossible. The classification of the ways in which context and context-dependence enter semantic analysis, though, is still a matter of much controversy and some (...) of these disputes are ventilated in the present collection. This book is not only a collection of papers addressing context-dependence and methods for dealing with it: it also records comments to the papers and the authors' replies to the comments. In this way, the contributions themselves are contextually dependent. In view of the fact that the contributors to the volume are such key figures in contemporary formal semantics as Hans Kamp, Barbara Partee, Reinhard Muskens, Nicholas Asher, Manfred Krifka, Jaroslav Peregrin and many others, the book represents a quite unique inquiry into the current activities on the semantics side of the semantics/pragmatics boundary. We study the relationships between definitions of compactness in topological spaces and the roll the axiom of choice plays in these relationships.

Starting dialysis at an advanced age is a clinical challenge and an ethical dilemma. The advantages of starting dialysis at “extreme” ages are questionable as high dialysis-related morbidity induces a reflection on the cost- benefit ratio of this demanding and expensive treatment in a person that has a short life expectancy. Where clinical advantages are doubtful, ethical analysis can help us reach decisions and find adapted solutions. Mr. H is a ninety-year-old patient with end-stage kidney disease that is no longer (...) manageable with conservative care, in spite of optimal nutritional management, good blood pressure control and strict clinical and metabolic evaluations; dialysis is the next step, but its morbidity is challenging. The case is analysed according to principlism (beneficence, non-maleficence, justice and respect for autonomy). In the setting of care, dialysis is available without restriction; therefore the principle of justice only partially applied, in the absence of restraints on health-care expenditure. The final decision on whether or not to start dialysis rested with Mr. H (respect for autonomy). However, his choice depended on the balance between beneficence and non-maleficence. The advantages of dialysis in restoring metabolic equilibrium were clear, and the expected negative effects of dialysis were therefore decisive. Mr. H has a contraindication to peritoneal dialysis (severe arthritis impairing self-performance) and felt performing it with nursing help would be intrusive. Post dialysis fatigue, poor tolerance, hypotension and intrusiveness in daily life of haemodialysis patients are closely linked to the classic thrice-weekly, four-hour schedule. A personalized incremental dialysis approach, starting with one session per week, adapting the timing to the patient’s daily life, can limit side effects and “dialysis shock”. An individualized approach to complex decisions such as dialysis start can alter the delicate benefit/side-effect balance, ultimately affecting the patient’s choice, and points to a narrative, tailor-made approach as an alternative to therapeutic nihilism, in very old and fragile patients. We study conditions for a topological space to be metrizable, properties of metrizable spaces, and the role the axiom of choice plays in these matters.

This paper reports the social and medical characteristics of women resident in Aberdeen city who were sterilized in 195162 and 197152 women were offered sterilization, the majority being lower social class mothers with five or more children who were sterilized concurrently with abortion; the small number of upper social class women had one or two children and were sterilized for medical or obstetric reasons. By 196172, women themselves requested sterilization, the two–three child family was the norm, the proportion of upper (...) social class women continued to increase, and interval sterilization was gaining ground.
